The Egyptian Association for Rights Protection, Social Justice and Intellectual Property “Hemaya” which has Mr. Ahmed El Meligi- the director and owner of Meligi Law Office- as a chairman of the board, has brought a case before the administrative court in the state council to cancel the Presidential decree 134 for year 2013 about the House of Representatives elections on 4 phases.
The law suit 28379 for the judicial year 67 stated that the Shura Council sent its elections to the Supreme Constitutional Court who rejected this law because it contradicts with the new constitution issued in Dec. 2012. The law returned to the Shura Council again in order to admit it according to the supreme constitutional judgment but we were surprised with the Presidential decree number 134 for year 2013 that announces the elections for the House of Representatives without mending the elections law and consider its constitutionality. The law suit assured that the decision of the President conflicts with the article 177 of the new constitution which stated the President and House of Representatives must present the draft of law regulates the legislative presidential and regional elections before it is issued just to decide its constitutionality.
The Supreme Constitutional Court normally issues its decision within 45 days.
At the end of this law suit, it has been officially assured that this law enables the Muslim Brotherhood with the control of all the different authorities and sectors of the state.
